A judge in the New York City government may have slipped up when he repudiated the US Constitution on the record during a trial. Essentially supporting secession from the federal government, judge Abena Darkeh proclaimed that the federal constitution did not exist in her courtroom. This decision absolutely violated the federal constitution and the US Supreme Court, which ruled in NYSRPA v. Bruen (2022) that NY’s tyrannical gun control laws were unconstitutional and were therefore invalid. If SCOTUS rulings apply to every area of the union, it means that for a SCOTUS ruling to not apply in a particular court, that court must be in a location that is not within the union.
It all started in 2022 when the NYPD and ATF raided the home of Dexter Taylor, confiscated his property, and arrested him. The 52-year-old black software engineer was charged with over a dozen crimes related to possessing firearms, which is nearly 100% illegal in NYC. Taylor took an interest in the engineering of firearms and assembled them from parts that he bought legally. He never fired any of the firearms, never sold them, and never committed any crimes with them (other than technically “possessing” them). After the trial, a jury convicted Taylor of 13 counts. During the trial, the judge prohibited Taylor’s lawyer from mentioning the Second Amendment in his opening statement in front of the jury:
“Do not bring the Second Amendment into this courtroom. It doesn’t exist here. So you can’t argue Second Amendment. This is New York.”
The judge interrupted attorney Varghese numerous times, including two sentences into his opening statement. She did not let him defend his client properly, making it practically impossible to win the case. Among the many violations of due process and state and federal law was Darkeh stopping Varghese from implying that the jury could find the defendant not guilty even if they believed that he did own firearms.
Taylor is in Rikers Island jail and will be sentenced in a few weeks.
Taylor and Varghese plan to appeal the decision.
One thing is for sure: Darkeh has never read The Pocket Guide To Killing Gun Control!
