On Thursday afternoon, New Hampshire Governor Chris Sununu announced via Twitter that he has created a new mandate which will go into effect in two days. All restaurants will henceforth be required to collect names, phone numbers, and times of arrival of all patrons indefinitely. No legislation created this law; it was an executive order by the Governor due to a request by the New Hampshire Lodging & Restaurant Association (NHLRA). The Governor has granted himself the power to do this because he granted himself indefinite powers months ago due to creating an executive order’ declaring a state of emergency, and renewing it each time it lapses, effectively making it perpetual.

Many people find it important to mention that there are nearly zero cases of COVID killing healthy people in New Hampshire. It remains a negligible risk. Throughout the US, the virus that is supposedly the most dangerous thing in the history of humanity has clearly not killed many people despite being in our society for a full year. If the virus were killing millions each day, the US would be full of dead bodies in the streets and life as we know it would not be the same. Considering that COVID has nearly 100% eliminated the seasonal flu, the number of deaths this year is hardly any different than the death rate in typical years. 

Within hours, multiple Republicans have condemned Sununu harshly for the order, both publicly and privately. The Republican State Representatives and activists have called the executive order communist and unnecessary. Prominent Republicans in New Hampshire have already indicated that they will not comply with the unconstitutional order.

Others have pointed out that in addition to being immoral, unreasonable, violative of property rights, based on propaganda, and a violation of the legislative process, this order violates the New Hampshire Constitution: 

[Art.] 2-b. [Right of Privacy.] An individual’s right to live free from governmental intrusion in private or personal information is natural, essential, and inherent.

In addition to current orders limiting the capacity of restaurants and increasing the amount of work they must do, this order will continue to hurt businesses – especially the struggling small businesses not affiliated with massive, wealthy restaurant chains. As the economy is crushed by increasing and ongoing regulations, more businesses will fail. As more businesses fail in response to communist mandates by politicians, we can look forward to living like the citizens of socialist Venezuela and receiving our guaranteed daily dose of bread as long as we wait in the lines that our government officials instruct us to.
